These General Terms and Conditions of Sale and Use (hereinafter the "GTCSU") govern the conditions of access, use and subscription to the services offered by the 2BCOACH mobile application.

The 2BCOACH app is available in French, English, Spanish and Arabic.

These GTCSU are written in French. In the event of translation into another language, only the French version shall prevail.

Information relating to the host of the application, the director of publication and other mandatory legal notices are accessible in the Legal Notice available from the application and, where applicable, on the 2BCOACH website at the following address: https://2bcoach.app/

Article 2 – Purpose of the application

2BCOACH is a mobile application dedicated to:

• football;
• physical preparation;
• player development;

The application allows users to access:

• training sessions;
• athletic programs;
• sports and nutritional advice;

The application can be downloaded from the Apple App Store and Google Play Store.

The use of these platforms remains subject to the terms and conditions of their respective publishers. The services offered by 2BCOACH are based on a personalized training method designed to support the player's individual progress.

This method includes the evaluation of the player's level, the definition of his objectives, the automatic generation of personalized training paths, the realization of evaluation tests, the monitoring of progress as well as the progressive adaptation of the sessions according to the results obtained.

The recommendations offered by the application are automatically generated based on the information provided by the user and the performance recorded during its use.

Article 3 – Acceptance of the GTCSU

2BC SAS may modify these GTCSU in order to take into account legal, regulatory or technical changes or the services offered.

The current version of the GTCSU is accessible at any time from the application and on our website.

When the changes substantially affect the rights or obligations of users in the context of an ongoing service, the users concerned are informed in advance under the conditions provided for by the applicable regulations. The amendments shall apply from the date of their entry into force, without prejudice to acquired rights and mandatory legal provisions applicable to current contracts.

The user acknowledges that he or she has read the GTCSU and accepts them without reservation by ticking the box provided for this purpose. The data kept by 2BC SAS (date, time, version of the T&Cs accepted) are authentic between the parties until proven otherwise.

Article 4 – Account creation

1. Registration requirements

Access to the services of the application requires the prior creation of a user account.

The account can be created using the authentication methods offered by the app, including using an email address, phone number, or a compatible third-party account, such as a Google or Apple account.

When registering, the user undertakes to:

• provide accurate, complete, and regularly updated information;
• maintain the confidentiality of their login details and not communicate them to a third party;
• not to create multiple accounts without the prior authorization of the Company.

The user is responsible for the use of his account as well as for any activity carried out using his credentials, subject to the applicable legal provisions.

After creating the account, the user is invited to create a player profile corresponding to the person who will use the training programs offered by 2BCOACH.

As part of the creation of the player profile, certain information may be requested, including first name, date of birth, gender, strong foot, preferred position and current club.

The specific conditions applicable when the player profile concerns a minor are specified in Article 4.2.

2. Use by minors

The programs offered by 2BCOACH can be used by minors from the age of 4, provided that they are adapted to their age and abilities.

A 2BCOACH account can allow the creation and management of a player profile corresponding to the holder of the adult account or to a minor under his responsibility.

When a player profile concerns a minor, his or her use of the application must be carried out with the authorisation and under the responsibility of his or her parent or legal representative who therefore accepts these GTCSU on his or her behalf.

The parent or legal representative is responsible for supervising the minor when using the app and carrying out the sports activities offered.

The subscription or purchase of a product must be made by a person with the necessary legal capacity to make the purchase.

2BC SAS does not systematically verify the identity or status of legal representative of the person creating or managing a player profile for a minor. This lack of verification does not exempt the parent or legal representative from complying with the obligations incumbent on him.

The conditions relating to the collection and processing of personal data of minors are specified in the Privacy Policy.

Each user account allows you to create and use a single player profile.

3. How the 2BCOACH method works

After the creation of the player profile, the player is invited to complete a questionnaire to evaluate his level as well as a questionnaire to identify his sporting objectives.

This information allows the app to generate a personalized training path.

The level evaluation questionnaire can be carried out at any time to allow the application to reassess the player's level and to adapt the recommendations, sessions and courses proposed.

The recommendations generated by the application constitute a personalized training aid and in no way replace the supervision of a sports educator, a trainer or a health professional.

Article 5 – Offers and subscriptions

Subscriptions to 2BCOACH are purchased exclusively through the Apple App Store or Google Play. Payment, invoicing, renewal and management of the subscription are carried out in accordance with the terms and conditions of the platform used at the time of subscription, without prejudice to the rights enjoyed by the consumer under the applicable regulations.

1. Discovery offer

2BCOACH can offer:

• a free session;
• limited access to certain features;
• Content accessible without subscription.

2BC SAS reserves the right to change the offers and prices applicable to new subscriptions or renewals, subject to compliance with the information obligations provided for by the applicable regulations.

2. Subscription offers

Full access to the relevant content and features requires a paid subscription. The subscriptions offered can be:

• monthly;
• semi-annual;
• annual.

The applicable rates are displayed in the application before any subscription. They may vary depending on the country, currency, platform or geographical area of the user.

The applicable price is the price displayed at the time of subscription or renewal, in accordance with the applicable conditions.

3. Automatic renewal

Unless otherwise specified at the time of purchase, subscriptions automatically renew at expiration in accordance with the terms and conditions specified by the Apple App Store or Google Play.

The user can turn off auto-renewal from the subscription management settings of the platform used for the subscription.

4. Payment

Payment for the subscription is made through the Apple App Store or Google Play, in accordance with the payment terms of the respective platform.

2BC SAS does not directly collect the bank details used for the payment of the subscription.

In the event of a failure, rejection, cancellation, or expiration of the payment or subscription, access to the paid features may be suspended or discontinued.

Subject to the effective validation of the subscription by the platform concerned, access to the features included in the subscription is activated in accordance with the subscribed offer.

5. Termination

The user can cancel or deactivate the automatic renewal of their subscription at any time from the subscription management settings of their Apple or Google account, depending on the platform used for the subscription.

Termination shall take effect at the end of the current subscription period, unless otherwise provided for by law or the applicable rule of the Platform.

Uninstalling the app or deleting the 2BCOACH account does not automatically terminate the subscription.

6. Right of withdrawal and refund

As 2BCOACH subscriptions are taken out and paid for through the Apple App Store or Google Play, requests for cancellation of a purchase or refund are made according to the procedures offered by the platform used at the time of subscription.

The applicable terms and conditions may vary depending on the platform and the user's country of residence.

These provisions apply without prejudice to the legal rights enjoyed by the consumer under the applicable regulations.

7. Legal guarantee of conformity of the digital service

The consumer benefits from the legal guarantee of conformity applicable to digital content and digital services, in accordance with Articles L. 224-25-12 et seq. of the Consumer Code.

2BC SAS provides the 2BCOACH digital service in accordance with the contract and the compliance criteria provided for by the applicable regulations.

Where the 2BCOACH service is provided on an ongoing basis during the term of a subscription, 2BC SAS shall be liable for any non-conformity that arises during the period in which the service is provided.

The compliance of the service is assessed in particular with regard to its functionalities, compatibility, accessibility, continuity and security, as well as the updates necessary to maintain this compliance.

In the event of a lack of conformity, the consumer benefits from the rights and remedies provided for in Articles L. 224-25-12 et seq. of the Consumer Code.

8. Account Deletion

The user may request the deletion of his account at any time from the settings of the application or from the 2BCOACH website, or by sending a request to the following address: contact@2bcoach.app.

Deletion of the account results in the deactivation of access to the account and the processing or deletion of personal data in accordance with the Privacy Policy and applicable legal obligations.

Deleting the 2BCOACH account or uninstalling the app does not terminate the subscription.

The user who wants to end their subscription must also cancel it from the subscription management settings in the Apple App Store or Google Play.

Article 6 – Sale of the training kit

1. Purpose

2BCOACH offers for sale physical training kits complementary to the sports programs offered in the application, depending on stock availability.

The contents of the training kit and its main features are presented before the order is validated.

When ordering, the user chooses the desired size of the ball from the sizes offered: size 3, size 4 or size 5. The products offered, their price, the countries in which they are available as well as any delivery restrictions are specified before the order is validated.

The training kits are sold and invoiced by the company 2BC SAS.

2. Pricing

Prices are indicated in euros including VAT.

Delivery costs are specified before the order is validated.

3. Shipping

The products are delivered to the address indicated by the customer when ordering. Orders are processed and shipped within 3 business days.

Once the order has been placed, we cannot guarantee that a change or cancellation can be made before it is shipped.

This provision does not affect the consumer's right of withdrawal in accordance with the applicable regulations.

The transfer of risks occurs upon physical receipt of the package.

For international deliveries, parcels may be subject to formalities, controls and decisions by the customs authorities of the destination country. These procedures may in particular result in a delay, detention, blocking or refusal of entry of the parcel into the territory concerned.

2BC SAS cannot be held liable for the consequences resulting from a decision or customs blockage beyond its control and which is not attributable to it, subject to the applicable mandatory legal provisions.

4. Right of withdrawal

The consumer customer has a period of fourteen (14) days from receipt of the kit to exercise his right of withdrawal.

To exercise this right, the client must inform 2BC SAS of its decision, in particular by e-mail to contact@2bcoach.app or via the withdrawal form available on the 2BCOACH website.

The kit must be returned within fourteen (14) days of notification of withdrawal, complete, unused and in its original packaging. The customer is responsible for any depreciation resulting from handling beyond what is necessary to verify the product.

Direct return costs are the responsibility of the customer.

2BC SAS will refund the sums paid, including the initial delivery costs within the limits provided for by the applicable regulations. The refund will be made after receipt and verification of the kit, with the same means of payment as that used for the order.

5. Legal guarantees

The products sold by 2BC SAS benefit from the legal guarantee of conformity and the legal guarantee against hidden defects, in accordance with the applicable regulations.

Article 7 – Availability of the service

1. Service availability

The Company implements the reasonable means necessary to ensure access to the Application 24 hours a day, 7 days a week.

However, access may be temporarily interrupted in particular for:

• maintenance ;
• update;
• security;
• technical constraints;
• force majeure.

The company cannot be held responsible for a temporary unavailability of the service.

The company also reserves the right to modify, suspend, replace or delete all or part of the functionalities, content, training programs, exercises, questionnaires or courses offered by the application, in particular in order to improve the services, ensure their security, correct anomalies or respond to technical, educational or regulatory developments.

2. Training sessions

Each session offered by 2BCOACH is built according to a defined pedagogical structure.

Unless otherwise specified, a session includes:

• three training exercises;
• an assessment test to measure the skills acquired.

The average duration of a session is about one hour.

The results obtained during the tests are analysed by the application in order to gradually adapt future sessions and to propose, if necessary, a change of level.

The application also offers à la carte exercises that can be carried out independently of a personalized course.

3. Recovery Time

In order to promote sufficient recovery and limit the risks associated with training overload, the application may prevent the start of a new session for a minimum of four (4) hours after the end of a session.

This limitation is an integral part of the 2BCOACH pedagogical method and does not constitute a malfunction or unavailability of the service.

Article 8 – Obligations of users

The user undertakes to:

• comply with these T&Cs;
• use the app fairly;
• not to affect the technical functioning of the service;
• not to disseminate illegal, hateful, violent or discriminatory content;
• not to reproduce or exploit the content without authorisation.

The user also undertakes to:

• Perform an appropriate warm-up before each session or exercise;
• Comply with the app's recommended recovery times.
• use suitable equipment in good condition;
• practice the exercises in a safe environment;
• not share their credentials with any third party;
• not to resell, assign or make available their account or subscription;
• not attempt to circumvent the technical limitations put in place by the application.

Article 9 – Health and safety

The user practices the sports activities offered under his or her responsibility or, when he or she is a minor, under the supervision and responsibility of his or her parent or legal representative, without prejudice to the responsibilities that may fall to 2BC SAS in application of the applicable regulations.

The account holder declares that the player's state of health is compatible with the practice of sports and that he knows of no contraindications.

Before any session or exercise, it is strongly recommended to perform an appropriate warm-up to gradually prepare the body for the effort and reduce the risk of injury.

The user undertakes to comply with the recovery times recommended by the application as well as all the instructions displayed when using the services.

In the event of pain, injury, discomfort or physical discomfort, the user undertakes to immediately interrupt the activity and, if necessary, to consult a health professional before resuming.

2BCOACH recommends consulting a healthcare professional before starting a training program, especially if you have a medical history, pathology, injury or doubt about your physical condition.

The content offered by the application does not constitute a medical act, nor a medical diagnosis, nor a treatment, nor a therapeutic follow-up.

Nutritional advice is provided for informational purposes only and is never a substitute for the recommendations of a doctor, dietician or other healthcare professional.

Article 10 – Intellectual property

All the elements making up the 2BCOACH application are protected by the provisions of the Intellectual Property Code and by any applicable regulations.

In particular, the following are protected:

• videos;
• the texts;
• training programs;
• exercises;
• questionnaires;
• assessment tests;
• personalized pathways;
• the 2BCOACH pedagogical method;
• personalization algorithms;
• trademarks, logos, graphic elements, interfaces and multimedia content;

Any unauthorized reproduction, distribution or exploitation is strictly prohibited.

When the user adds a profile picture or any other personal content allowing the personalization of his account, he retains the rights he has to this content and authorizes 2BC SAS to host, reproduce and display it only to the extent necessary for the operation and provision of the 2BCOACH services. This authorization ends when the content concerned is deleted, subject to any applicable legal retention obligations.

Article 11 – Liability

The content offered by 2BCOACH aims to support the individual progress of users.

However, the company does not guarantee any sporting, physical, technical or nutritional results.

A player's performance and progress depend on his or her initial level, state of health, attendance, quality of execution of exercises, compliance with instructions, recovery times, training environment and many factors beyond the control of society.

Consequently, 2BC SAS does not guarantee a specific sporting progression, a specific technical improvement, or a selection in a club, a team or a competition. The company cannot be held liable for damages resulting in particular:

• misuse of the application;
• failure to comply with safety instructions;
• lack of warm-up;
• Failure to meet recommended recovery times.
• inappropriate use of exercises;
• a state of health incompatible with the practice of sport;
• a technical incompatibility of the equipment used;
• a temporary or permanent interruption of service.

The company's liability is, in any event, limited to direct, personal, certain and proven damage resulting from a proven fault on its part.

Article 12 – Account suspension or deletion

The Company may suspend or delete an account if:

• of fraud;
• non-payment;
• violation of these T&Cs;
• misuse of the Services.

The Company may also suspend or delete an account in the event of credential sharing, attempting to circumvent technical limitations of the application, fraudulent use of a subscription, or any use likely to undermine the security, proper functioning or interests of the application.

Article 13 – Personal data

Personal data is processed in accordance with:

• the General Data Protection Regulation (GDPR);
• to the Data Protection Act.

The methods of processing personal data are detailed in the Privacy Policy accessible from the application. The user may exercise their rights of access, rectification or deletion at the following address: contact@2bcoach.app

Information relating to the technical service providers used by the application, any international data transfers, the retention periods of personal data as well as the security measures implemented are detailed in the Privacy Policy accessible from the application.

Article 14 – Mediation

In accordance with the provisions of Articles L.612-1 et seq. of the Consumer Code, any consumer has the right to have recourse free of charge to a consumer mediator for the amicable resolution of a dispute between him and the company 2BC SAS.

The user may have recourse to this mediator after having sent a written complaint to the company 2BC SAS and provided that no amicable solution has been found.

Article 15 – Applicable law and jurisdiction

These T&Cs are subject to French law, without prejudice to the mandatory provisions applicable to consumers.

In the event of a dispute, the parties will seek an amicable solution as a priority.

In the absence of an amicable agreement, the competent courts will be determined in accordance with the applicable legal rules.
